Dispute Resolution at Sundance Ltd.

At Sundance Ltd., we believe in resolving disputes through a structured yet flexible approach, aligning with best practices and the unique nature of each dispute:

  • Online Dispute Resolution (ODR): For disputes arising from online transactions or those that can be effectively managed online, we may offer ODR. This is a flexible, cost-effective method which uses ADR principles and can involve AI-driven processes for efficiency.
  • Consensual Resolution: Initially, disputes are encouraged to be resolved through direct communication and negotiation between the parties, aiming for a mutually agreed solution.
  • Mediation: If direct resolution is not achieved, mediation is the next step. This involves a neutral third party facilitating discussions between the parties to aid in reaching a consensual agreement. The mediator does not make decisions but helps guide the parties to a mutually satisfactory resolution.
  • Arbitration: Should mediation not lead to a resolution, arbitration may be considered. This process involves an independent arbitrator who listens to both sides and makes a binding decision. Arbitration is particularly suitable for disputes requiring a determinative outcome based on legal rights or entitlements.
  • Referral to the Disputes Tribunal: For certain disputes, especially those within the Tribunal’s jurisdiction and financial limits, this provides a simpler and more cost-effective alternative to court proceedings.
  • Court System: For larger sums, and as a last resort, unresolved disputes may be escalated to the formal judicial system. Court proceedings are considered after all other methods have been explored, keeping in mind the time, cost, and potential impact on relationships.

Sundance Ltd Computers – Terms & Conditions

1. Scope of Terms
These Terms and Conditions (“Terms”) govern all interactions and transactions with Sundance Ltd (“us”, “we”, or “our”), including but not limited to the use of our website SundanceComputers.nz (“the Service”), purchases of products, and services rendered by us or our subcontractors.

2. Acceptance of Terms and Requesting Exemptions
By interacting with Sundance Ltd Computers in any manner, you agree to be bound by these Terms. We understand that certain situations may require flexibility. If you find a specific section or sentence in these Terms that you believe is not applicable or poses a concern for your particular circumstances, we encourage you to immediately cease using our services and contact us for a possible exemption. Exemption requests can be submitted through the ‘Contact Us’ page on our website. Each request will be considered on a case-by-case basis, and we will endeavor to work with you to find a mutually agreeable solution.

3. Purchase and Payment Terms

  • Invoice and Payment Due: Payment for products or services provided by Sundance Ltd Computers is due upon receipt of the invoice.
  • Late Payment Fees: Accounts not settled by the 20th of the month following the invoice date, or within 7 days of any prearranged payment schedule, will incur a late fee of 10% of the outstanding balance. For accounts that remain unpaid beyond these time frames, an additional 10% late fee will be compounded on the remaining balance for each subsequent month or agreed payment period until the account is fully settled.
  • Retention of Title (Romalpa Clause): Ownership of goods shall remain with Sundance Ltd Computers until full payment for the goods has been received. This retention of title applies to all goods supplied, notwithstanding their incorporation into other products or their alteration by any process.
  • Restrictions on Goods: Goods supplied by Sundance Ltd Computers must not be on-sold or transferred to a third party until full payment is made.
  • Use of Equipment: Equipment supplied must be used in accordance with the manufacturer’s intended purpose and guidelines. The equipment should not incur damage beyond normal wear and tear until full payment has been made. Any misuse or damage beyond normal wear and tear may result in additional charges or legal action.
  • 3.5 “Shipping, Availability, and Cost Flexibility”
  • In today’s unpredictable market, both products and services might face availability issues or unexpected cost increases. Here’s how we handle these challenges:
  •   Immediate Communication: If we can’t fulfill an order due to availability or cost changes, we’ll inform you promptly to discuss next steps.

4. Equipment Recovery in Cases of Extended Non-Payment
Overdue accounts (60 days) may be subject to collections and legal action. We reserve the right to investigate suspected wrongdoing. Confirmed misconduct in court may result in claims for damages and court costs. In the unfortunate event that an account involving equipment remains unpaid for over 90 days, you agree to cooperate in the recovery of the equipment. This may include allowing the use of law enforcement, where appropriate with consideration to current legal standards, to accompany our representative to your business or personal residence for the purpose of identifying and recovering the said equipment. Furthermore, you agree to bear any reasonable costs incurred for such law enforcement services. We sincerely hope that this clause never needs to be enacted. We value our relationships with our customers and understand the mutual importance of trust and cooperation. Please understand that pursuing recovery through law enforcement is a last resort for us. The additional time, effort, and expense involved significantly outweigh any potential profit from the sale. Our preference is always to resolve payment issues amicably and without such measures, and we kindly request your cooperation to ensure that such a situation does not arise.

While Sundance Ltd. provides products and services “as is” and without warranties of any kind, express or implied, we acknowledge that some products may come with manufacturer warranties. These warranties exist in addition to the statutory rights under the CGA. If we do not meet these guarantees, customers are entitled to remedies, including repair, compensation, or refund, depending on whether the issue is minor or serious. It should be noted that the CGA may not apply in transactions where both parties are in business, and there is an agreement to contract out of the CGA’s requirements. Such an agreement must be in writing and fair and reasonable to both parties. In case of a dispute that cannot be resolved through our Disputes Resolution page, customers may take the matter to the Disputes Tribunal or District Court.

Refund and Returns Policy

Overview

Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

  • Book with obvious signs of use
  • CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.Late or missing refunds

Exchanges

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, you should mail your product to: {physical address}.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Please be assured that we take your concerns seriously and endeavour to provide timely resolutions to all fair and reasonable requests.

Firstly, if you have a complaint, comment, or compliment feel free to fill out one of our many reply forms scattered throughout our website and marked as “Leave a Reply” or do so on our Contact us page.

Secondly, if your concern has not been addressed to your satisfaction, we are happy to engage in mediation with you. Feel free to choose a mediation service of your liking and give them our contact details, but only after allowing a reasonable time for us to adequately address your concern.

Thirdly, the Ombudsman is available in extreme cases where private mediation does not prove fruitful. Please be advised that the decision of the Ombudsman is final.

It is our sincere desire to avoid litigation. We spend numerous hours reviewing legal recommendations and guidelines, retain legal council, and subscribe to governmental mailing lists for timely updates in order to avoid misconduct.
